MEMORANDUM* OVERVIEW Joe White timely appeals his jury conviction of one count of aggravated sexual abuse on an Indian Reservation, in violation of 18 U.S.C. §§ 2241(a)(1) & 1153. White argues that the district court erred in giving a jury instruction on voluntary intoxication and that the statute under which he was convicted, the Major Crimes Act, is an unconstitutional application of a general criminal code to the activities of Indians who live in Indian Country.
