Tallaseehatchie Creek Watershed

ALMON, JUSTICE. This is an interlocutory appeal, pursuant to Rule 5, Ala. R. App. P., by Tallaseehatchie Creek Watershed Conservancy District (""TCWCD"") from an order of the trial court denying its motion to dismiss the plaintiff's action. The only issue is whether TCWCD is clothed with sovereign immunity by virtue of Ala. Const. 1901, art. I, § 14, and therefore is not subject to suit in the courts of this state.
