In an action to dissolve a partnership, the trial court granted defendants motion for a summary judgment sought because the pleadings, admissions, stipulations, and affidavits filed in the case showed no genuine issue as to any material fact and the movant was entitled to judgment as a matter of law; and this is an appeal therefrom. Simultaneously defendants counterclaim was dismissed since defendant had agreed that this might be done if his motion for summary judgment was granted.
