Action for breach of contract brought by Vernon E. Toulon, appellant, against John W. Nagle, respondent, seeking recovery of one half of the profits of Nagle Motors, Inc. (formerly Nagle-Toulon, Inc.) or one half the increase in the value of the stock of that corporation due to profits, from the date business was commenced by the corporation in January, 1967. The action was based on an alleged oral contract permitting the appellant to purchase one half of the stock of the corporation, a tender of payment for which was allegedly rejected by the respondent.
