Publisher Description

Among other criteria, the proponent of an adverse possession claim must establish that the alleged use was both hostile and exclusive. Here, Margaret Enderlein claimed title by adverse possession to a strip of land approximately five feet wide by 200 feet long that is within the record title line of adjacent property. But the record fails to establish that her use of the strip was either hostile or exclusive. We affirm the summary dismissal of her action.
