Publisher Description

The Torrington Company and Badger Bearing Company (Torrington) appeal from a judgment entered after a jury rendered a verdict of liability and damages against it in favor of Gary Foat and his wife, Louise Foat, in a products liability and negligence cause of action. Torrington raises four claims of error: (1) the trial court failed to impose sanctions against the plaintiffs for destroying and failing to preserve critical evidence; (2) there is no credible evidence to support the jury's findings of causation; (3) a computer simulation depicting defendant's theory of the case and a film of a stress-load test was improperly excluded from evidence; and (4) public policy considerations mandate reversal of the judgment.
