[U] Fulton v. Erp Operating Ltd. Partnership

Deanna Fulton and Kevin Kincheloe (collective Fulton) sued ERP Operating Limited Partnership for water damage to their possessions caused by a pipe that froze and burst in the unheated attic of their building. After ERP rejected Fultons two offers to settle the case for $3,750 and then $3,500, the case went to trial. The trial court ultimately ordered ERP to pay $4,024.12 to Fulton, plus $8,915 for Fultons attorney fees and $305.25 for court costs. ERP appeals.
