[U] Gehlen v. Snohomish County Public Hospital Dist. No. 1

G. Lester Harms, M.D., appeals the judgment against him in a medical malpractice action brought by the estate of Charles J. Gehlen, M.D. We hold that the trial court did not abuse its discretion by refusing to give Dr. Harms hindsight instruction, by allowing Drs. Saul Suster and Hector Aldape to testify about the tumor progression theory, and by refusing to admit Dr. Geoffrey Loftus to testify about visual perception. We further hold that the estate produced adequate evidence on the relevant standard of care. Accordingly, we reject Dr. Harms arguments and affirm the trial courts judgment.
