ZATKOFF, District Judge. Defendant-appellant Akron Firefighters Association, AFL-CIO, Local 330 ("Local 330") appeals the district courts order approving a consent decree between plaintiff-appellee United Black Firefighters Association ("UBFA") and defendant-appellee City of Akron ("City"). The consent decree will increase the percentage of black firefighter/medics who are promoted to the position of lieutenant in the Akron Fire Department by promoting all persons who are ranked numbers one through fifty-nine on the applicable promotions list by August 31, 1992, regardless of whether fifty-nine lieutenant positions actually become available during this time.
