WALTERS, C.J. Virgil and Katherine Young appeal from a summary judgment dismissing their action to compel the Department of Law Enforcement
to issue them a retail liquor license. In October, 1991, the Department offered the Youngs a license, but expressly advised
that in order to claim the license, they must, within ten days, notify the Department in writing of their intent to accept.
When it did not receive written notice from the Youngs within ten days, the Department dropped them from its waiting list
and offered the license to another applicant, Brent Hansen.
