Volk v. Mccormick

The complaint seeks damages for alleged medical malpractice and false representations made thereafter. The alleged malpractice took place on April 28, 1964. The complaint was served July 10, 1967. The defendants demurrer is upon the grounds (1) that the three-year statute of limitations (sec. 893.205, Stats.) bars the claim for malpractice, and (2) that the complaint does not state facts sufficient to constitute a cause of action.
