Publisher Description
HEANEY, Circuit Judge. The sole issue presented in this appeal is whether section 202 (l) of the Social Security Act, which limits the benefits that survivors of individuals who are fully insured under both the Social Security Act and the Railroad Retirement Act may receive, violates the equal protection component of the due process clause of the fifth amendment. The district court1 applied the rational basis test and held that the statute satisfied this constitutional standard. We affirm.
