Barczak v. State

1) Patricia K. Barczak appeals from a Superior Court decision affirming the Industrial Accident Boards decision denying Barczak the full amount she requested as compensation for certain permanent injuries. Barczak argues that the Board erred in: (i) not permitting her to amend the pre-trial memorandum to include an additional witness; (ii) sua sponte raising the issue of compensability; (iii) con-sidering the duration of her disability as a factor in assessing the degree of her disability; (iv) accepting only the medical testimony that was based upon the AMA Guide; and (v) not awarding her attorneys fees.
