1 Appellant, Lee Boyd Barham, hereinafter referred to as defendant, was charged, tried and convicted in the District Court of Tulsa County, Case No. CRF-72-402, for the offense of Shooting with Intent to Kill, After Former Conviction of a Felony, his punishment was fixed at a term of not less than twenty-five (25) nor more than thirty (30) years imprisonment, and from said judgment and sentence, a timely appeal has been perfected to this Court.
