The appellees, Carl Phillips and his wife, brought this action against South Bend Osteopathic Hospital, Inc. for damages occasioned by an injury to Mr. Phillips while he was a patient at the hospital.[Footnote 1] The claim alleged that Phillips was injured through the negligent administration of a hypodermic injection by a registered nurse who was in the regular employ of the hospital. The case was tried by jury and resulted in a judgment for the plaintiffs.
