James E. Kosbruk was convicted of two counts of second-degree sexual abuse of a minor in violation of AS 11.41.436(a)(2).
Kosbruk was sentenced to six years with one year suspended on each count. The sentences were ordered concurrent. Kosbruk also
received a five year term of probation. Kosbruk appeals his conviction claiming the court erred on several evidentiary matters.
He appeals his sentence claiming the court improperly rejected a mitigating factor. We affirm. Kosbruk was visiting the home of Mr. and Mrs. S., when Mr. and Mrs. S. decided to go to the video store. They brought one
of their four children with them. The other three children remained at home with Kosbruk.
