Appellant, Joseph Carter was charged with voluntary manslaughter in connection with the death of Tolley and was bound over to stand trial in the district court. After various pretrial motions, which did not include a motion to suppress, trial was commenced on April 19, 1978. The jury found Carter guilty as charged.
