FACTS. - The Department of Employment Security determined that workers for Rousay were employees and assessed contributions. Rousay argued that they were independent contractors and sought to call as a witness an Industrial Commission employee who had helped draft the independent contractor agreement in question. The Department refused to subpoena the Industrial Commission employee but rather spoke with him behind the scenes. PROCEEDINGS. - Rousay sought judicial review.
