QUA, JUSTICE. This action is to recover for personal injury and property damage resulting from a collision at a grade crossing in Pittsfield between an oil truck driven by the plaintiff and a freight train of the defendant. The plaintiff had a verdict on his common law counts. The defendant excepts.
