Publisher Description

In substance the first order held that the court had obtained personal jurisdiction over defendant-appellant. The second order
was a repetition of the first one in response to a motion for rehearing. In form, the orders denied defendant's motions to
set aside service of process on defendant. Kay Teubert, a pupil in the high school at Delavan, is alleged to have been accidentally injured in a gymnasium class and
the injuries caused medical expense to plaintiff, Gertrude Teubert, her mother. The complaint alleges that defendant, Wisconsin
Interscholastic Athletic Association, hereinafter referred to as the 'Association', is a voluntary benefit plan organized
under secs. 185.991 to 185.996, Stats., and is engaged in operating an accident benefit plan covering students in Wisconsin
schools, and Kay Teubert was so covered at the time of her accident. Plaintiff has demanded payment of the expense so caused
and so covered and demand has been refused.
