1 Jim Igo, plaintiff in error, hereinafter referred to as defendant, was charged by information in the district court of Coal County with the crime of murder, a second and subsequent offense. He was alleged to have on or about the 21st day of April, 1952, murdered his wife, Pearl Igo, by beating and choking and by strangulation. The jury found the defendant guilty as charged, and assessed his punishment at confinement in the State Penitentiary for the term of his natural life.
