Plaintiff has appealed from an order of the trial court granting defendant-appellees motion to dismiss and dismissing plaintiffs amended complaint with prejudice. Defendants motion was grounded upon absence of an affirmative allegation that notice of plaintiffs damages was given to defendant within the time required by law.
