The opinion of the court was delivered by Arlan Kaufman, Ph.D., appeals the decision of the district
court affirming the finding of the Department of Social and
Rehabilitation Services (SRS) that two residences owned by Dr.
Kaufman and his wife, Linda Kaufman, are residential care
facilities and required to be licensed pursuant to K.S.A.
75-3307b(a)(5). Kaufman claims: (1) The premises are not
facilities subject to licensing under K.S.A. 75-3307b, and (2)
K.S.A. 75-3307b is unconstitutionally vague. Kaufman's appeal was
transferred to the Supreme Court pursuant to K.S.A. 20-3018. Arlan Kaufman and his wife, Linda, are the owners of two
houses, collectively known as Kaufman House, in Newton, Kansas.
Dr. Kaufman holds a masters degree in social science and a Ph.D.
degree in social work. Mrs. Kaufman is a registered nurse
licensed by the State of Kansas.
