1) pursuant to Supreme Court Rule 25(a), the State has moved to affirm a judgment of the superior Court denying Lundy-Beys post-conviction relief petition under Superior Court criminal Rule 61(i)(4) ("Rule 61(i)(4)"). The State contends that the issues raised in Lundy-Beys opening brief are clearly controlled by settled Delaware law and the Superior Court did not abuse its discretion by denying appellants petition. We agree.
