Two actions in the district court for Hubbard county, consolidated for trial and heard together on appeal, one on behalf of Kenneth Smith, a minor, for injuries sustained by him while sliding on a chute maintained on the premises of defendants, Otto Hendrickson Post 212, American Legion, and Lampert Lumber Company, and the other by Virgil Smith, father of the injured boy, for medical expenses. The cases were tried before Arnold C. Forbes, Judge, and a jury, which returned verdicts of $39,600 and $5,000 for Kenneth and Virgil Smith respectively. The court denied each defendants motion for judgment notwithstanding the verdict in each case, and defendants separately appealed from the judgment in each case.
