Gary W. Ketter, M.D. and Gary W. Ketter, M.D., P.A. appeal the judgment in favor ESC Medical Systems, Inc. and Eclipse Medical, Inc. Ketter brings four issues asserting the trial court erred by (1) granting Eclipses traditional motion for summary judgment that merely adopted ESCs motion; (2) granting ESCs and Eclipses no-evidence motions because they lacked sufficient specificity; (3) considering an unsworn statement as an affidavit in support of ESCs traditional motion for summary judgment; and (4) granting ESCs and Eclipses traditional motions for summary judgment on Ketters causes of action for common-law fraud, breach of implied warranty, violation of the Texas Deceptive Trade Practices Act (DTPA) and for Ketters "loss of reputation." We reverse in part and affirm in part.
