4000 Old Pali Road Partners v. Lone Star of Kauai Inc‪.‬

[1] The defendant was charged in a county attorneys information filed in the district court of Page County, Iowa, with the crime of larceny from the person of Jennie Maxwell of a sum of money in excess of $20. The defendant entered a plea of not guilty. A trial was had and on submission of the case to the jury it returned a verdict of guilty of the crime of larceny of property in excess of $20. A motion for a new trial, including exceptions to instructions, was later submitted and was overruled by the trial court. The defendant thereafter was sentenced to imprisonment in the state penitentiary at Fort Madison, Iowa, for a period not to exceed five years. He has appealed.
