This case involves the contest before probate of the will of Margherita Gagliasso who died in November 1954. Contestants are the three daughters of decedent. The contest was based on the grounds of lack of due execution, unsoundness of mind, and undue influence and fraud in procuring the wills execution. The court granted a nonsuit at the close of the contestants case. There is no question presented as to the due execution of the will, but appellants urge that there was sufficient evidence to go to the jury on the other grounds.
