HELD. - Relative negligence was to be compared in a wrongful death case. Applying the Probate Code definition of "heirs," the decedents siblings were not heirs for purposes of the wrongful death statute. The court would not consider possible error in refusing to set aside a stipulation for introduction of evidence, where the record did not include a transcript from which the effect of the evidence could be ascertained.
