ORDER Henry R. Horsey, Justice This 24th day of August, 1988, plaintiff-appellee Apex Financial Corporation having filed on August 10, 1988 a motion to dismiss the within appeal or, in the alternative, to affirm the judgment of Superior Court, pursuant to Rule 25(a), on the grounds stated in appellee's motion papers with attached exhibits; and it further appearing that defendant-appellant Davis S. DeReimer not having filed a response to said motion within the time provided under Rule 30(b) and Rule 11(c), and the motion is thereby deemed to be unopposed under Rule 30(c); NOW, THEREFORE, IT IS ORDERED that the within appeal be and the same is hereby DISMISSED, pursuant to Rules 29(b), 30(c), and 3(b).
