When judgment on the pleadings cannot be granted. 1. A judgment on the pleadings cannot be granted: (a) Where allegations of a complaint cover material and necessary matters which are properly denied by the answer; (b) where an answer alleges proper affirmative defenses to plaintiff's cause of action. There should be no findings of fact when judgment is granted on the pleadings.
