Selman, as mortgagee of the premises insured, in a suit against the St. Paul Fire & Marine Insurance Company for the full amount of insurance benefits therein provided. The theory of the suit was that of a liquidated demand on account of a total loss by fire of property insured pursuant to provisions of Article 6.13 of the Insurance Code, Vernons Ann.Civ.St.
