Appellants herein, being Joseph Gaynor, Carmen Apicella and Cass Casmir, were charged by indictment with the crime of conspiracy to commit second-degree burglary in that they did unlawfully, knowingly and feloniously combine, conspire, confederate and agree to and with each other in the felonious intent to burglariously break and enter a business building wherein was located the tavern (hereinafter called State Tavern) of Vasco and Vincent Cataldi to unlawfully take and carry away the personal goods and property of the Cataldis.
