In an action to rescind a contract for the sale of real property, the plaintiffs appeal from a judgment of the Supreme Court, Richmond County (Sangiorgio, J.), entered September 4, 1997, which, upon an order of the same court, dated July 29, 1997, granting the defendants motion to dismiss the complaint, is in favor of the defendant and against it.
