Defendant-appellant Richard Thomas [hereinafter "Thomas"], appeals from the district courtsNovember 26, 2002 judgment convicting him of the offense of harassment, in violation of Hawaii Revised Statutes [hereinafter "HRS"] § 711-1106(1)(a) (Supp. 2002). On appeal, Thomas presents the following two points of error: (1) the district courts findings of fact were clearly erroneous, and its conclusion of law, adjudging him guilty of the charged offense, was wrong; and (2) the prosecution failed to adduce sufficient evidence to overcome the presumption of innocence to which he was constitutionally entitled.
