The State appeals a trial court order vacating Askari Muhammads death sentence and granting a new sentencing proceeding pursuant to Muhammads Florida Rule of Criminal Procedure 3.850 motion. Muhammad cross-appeals the denial of his claim that he is entitled to have his conviction for first-degree murder vacated and also petitions this Court for a writ of habeas corpus. We have jurisdiction. See art. V, § 3(b)(1), (9), Fla. Const. For the reasons expressed below, we reverse the portion of the trial courts order vacating Muhammads death sentence.
