1. By the provisions of 2 Mason Minn. St. 1927, ? 7247, a maker of a promissory note is not liable upon it if it is made to appear that his signature was obtained by fraudulent representation, trick, or artifice as to the nature and terms of the contract; that he did not believe the instrument to be a promissory note; and that he was not negligent in signing without knowledge of its terms.
