Mr. Carpenter, for the appellant: The law is settled in Wisconsin, by Walker v. Shepardson,3 that the owner of land bordering upon a fresh-water stream, above the ebb and flow of the tide, owns to the centre of the stream, subject to the right of the public to use the same as a highway where it is navigable in fact.
