Baron Desnick v. Joseph Mast and Others

Action in the Ramsey County District Court for damages allegedly resulting from breach of professional and fiduciary duties by defendants, Joseph Mast, Arnold Divine, and Stanley Starkman, and from an alleged conspiracy among them to exclude plaintiff from participating in the purchase of a business. He also sought an accounting from defendant Starkman, who purchased the business. Said defendant counterclaimed, seeking specific performance of an alleged agreement by plaintiff to transfer certain stock in another business to him. The court, Hyam Segell, Judge, ordered plaintiff's action dismissed, determined that Starkman was entitled to damages on his counterclaim, and denied plaintiff's motion for a new trial. Plaintiff appealed from said order and the judgment entered. After subsequent testimony the court awarded Starkman $17,500. Plaintiff appealed from the supplementary judgment entered accordingly and Starkman filed a notice of review. AUTHOR: PETERSON
