On February 11, 2000, Dena Browning filed a complaint in the Ohio Court of Claims in which she named the Ohio State Highway
Patrol ("highway patrol"), Trooper Edward Mejia Jr., and Patrol Sergeant Michael D. Black as defendants. The complaint included
eleven separate counts, including counts designed to ascertain whether Trooper Mejia and Sergeant Black had been acting within
the scope of their employment when the activities giving rise to the claim had occurred.
