Mr. Gerhard contended–– 1. That the vessel was not seaworthy at the commencement of the voyage, and that therefore the owners were responsible for the total loss of the articles thrown overboard. 2. That there was such a neglect of proper precaution during the voyage as to make the vessel responsible.
