Publisher Description
HALL, Chief Justice: This is a products liability action, brought by Kathleen and Dennie Barson as guardians ad litem for Elizabeth Ann Barson against E. R. Squibb and Sons (Squibb), a New Jersey corporation. In the complaint, it was alleged that Elizabeth had suffered serious birth defects as a result of the prenatal administration to her mother of a progestational drug, Delalutin, manufactured by Squibb. Plaintiffs suit was based on three separate theories: negligence, breach of warranty and strict liability. Squibb appeals the jury verdict of $1.5 million for Elizabeth and seeks a new trial.
