SYLLABUS BY THE COURT The record is examined in a malicious prosecution action resulting from a medical malpractice action filed against the plaintiff, and it is held under the facts of this case that the district court did not err in (1) finding the defendants clients relied upon the advice of counsel in filing the medical malpractice action, (2) finding that the defendants attorneys acted with probable cause in filing the medical malpractice action, and (3) granting summary judgment in favor of the defendants.
