On January 31, 1971, Thomas Kerby was 34 years of age and married to the plaintiff. The couple had two children, aged five years and 14 months. Kerby was in good health and employed full-time as an insurance salesman and part-time as a Yellow Cab driver on weekends. In addition to his employment, Kerby was enrolled in college to obtain a masters degree in business.
