Action by Charles Panzer, plaintiff, commenced on December 12, 1945, against Eileen Hesse and the Saint Paul Mercury Indemnity Company, a corporation, defendants, to recover for injuries sustained by plaintiff when struck by defendant Hesse's automobile. The action was tried to the Judge and jury and a special verdict rendered. Defendant Hesse was found causally negligent in respect of control and lookout. Plaintiff was found negligent as to lookout, but this was found not to have been a cause of the accident. Plaintiff was exonerated from negligence in respect of his position on the highway. Plaintiff's damages were appraised at $2,500. Upon motions after verdict the trial court ordered judgment for plaintiff. Judgment was entered on March 12, 1946. Defendants appeal.
