Publisher Description

BUTZEL, C.J. By original petition for the writ of and the ancillary writ of certiorari, the mother of Margaret E. Payette seeks to secure the latter's release from the State home & training school at Lapeer, Michigan, to which she was committed in 1943, when 14 years of age, by the order of the probate court of the county of Midland. Petitioner alleges that the girl was illegally committed without due process of law; that no notice of hearing was served on the girl; that there was no order of substituted service, or that service be dispensed with; that the record does not disclose that there was any order for the appointment of examining physicians; that the latter's reports were fatally defective in only stating Conclusions of others and not fact based on the physician's own examination; that the report of one of the physicians only describes the child as an ""alleged feeble-minded person.""
