Publisher Description
Claimant seeks review of a court of appeals opinion denying his workers compensation award. The court vacated the award because the administrative law judge (ALJ) did not strictly adhere to the American Medical Associations Guides to the Evaluation of Permanent Impairment (the AMA Guides) when determining the percentage of claimants permanent impairment. We must decide whether an administrative law judge is bound to follow the AMA Guides as the sole measure of impairment. We have jurisdiction under Ariz. Const. art. 6, § 5(3); A.R.S. §§ 12-120.24 and 23-948; Rule 23, Ariz.R.Civ.App.P., 17B A.R.S.
