Publisher Description
Michelle Smasne was found in contempt of court for failing to follow the terms of the parties parenting plan. She filed a motion to revise the commissioners ruling, which was denied. We remand for findings regarding evidence of bad faith, if any, on the part of Ms. Smasne as well as a lack of a reasonable excuse, if any, for failing to comply with the order. If an order of contempt is supported by the findings, the commissioner must also comply with the terms of RCW 26.09.160(2)(b)(i)-(iii). Although Robert Smasne originally filed a cross- appeal requesting attorney fees for having to respond to this appeal, he did not brief the issue and it was deemed waived by our court clerk.
