At a hearing conducted in March 1998, the Medical Quality Assurance Commission considered multiple charges of unprofessional conduct brought by the Department of Health against Dr. James R. Irwin. It concluded that the Department had proven only three of the charges by a preponderance of the evidence. Dr. Irwin appealed the Commissions decision to the superior court, which reversed. The court held that the evidence was not sufficient to support the Commissions decision. The Commission then filed this appeal in the Court of Appeals.
