Publisher Description
Defendant appeals from a conviction of perjury in the first degree. He asserts the court erred in (1) refusing to dismiss the perjury charge because the testimony offered by the state was insufficient to prove the materiality of the perjured testimony; and (2) determining the question of materiality without having the entire record of the previous proceeding before it. We find no error.
